All Applicants Over The Age Of 18 |
The
County Clerk's office in each Californian county is authorized
to issue marriage licenses. There is a cost for the marriage
license, which is valid for 90 days from issuance. County Clerk
marriage license issuance locations are limited in each Californian
county. There are two types of marriage licenses in California.
In
regards, to the California "Confidential Marriage License",
this may also be issued by clergy/notaries specially authorized
by a specific county. County approved clergy/notaries are
few. The Clergy Network is one of the few approved in Orange

Whether issued by the Orange County Clerk or The Clergy Network
of Southern California located in Orange County California,
both applicants must be present for issuance of California marriage
license.
Certain acceptable forms of identification must be presented
to the County Clerk or the TCN representative issuing the marriage
license (required to verify name, age, and identity). A picture
ID, such as a valid Driver's License, or current Passport or
California ID or Military ID. Only one of the above identifications
must be presented to the Orange County Clerk or The Clergy Network,
depending upon whom is issuing the marriage license. |

For
Applicants Previously Married |
When
previously married and applying for a California Marriage
License, the following:
- Marriage
Ending By Divorce From Last Spouse - If previously married,
the final divorce decree may be required for verification
of the finalized divorce. For example, if a divorce was
finalized within six months of the application for a marriage
license, then the final decree must be presented upon marriage
license issuance. But, if a divorce was finalized beyond
six months from the marriage license application, the final
decree is not required. In this case, only the day, month
and year of the finalization of the divorce is required.
- Marriage
Ending By Death Of Last Spouse - If the last marriage
was ended by the death of a spouse, more than six month
from application date, then the day, month, and year must
be furnished. But, if the death of the spouse was within
six months of applying for a marriage license, then an official
death certificate must be furnished.
- Waiting
Period After Application Or Issuance Of A California Marriage
License - There is no waiting period. The marriage license
may be used upon issuance (A marriage may be solemnized
immediately upon marriage license issuance). Once issued,
a marriage license is valid for 90 days.

Blood
Tests Or Marriage Medical Certificates
As of January 1st 1995, no blood test is required as a part
of the application or issuance of a California marriage license. |

Types
Of California Marriage Licenses
The two main types of California Marriage Licenses are - 1.
Public Standard License (may be issued in any County in California
and couple may be married in any County in California 2. Confidential
Marriage License (must be obtained in the County of marriage.)
Couple must marry in the same county as marriage license was
issued.
- California
Public Standard - The "Public Standard Marriage
License" is a public record. This means that anyone
may purchase a "certified copy" of any couple's
marriage license when married within the State of California.
Once issued this type of marriage license allows the couple's
marriage ceremony to take place anywhere within the State
of California.
- California
Confidential - If the applicants are eligible and are
issued the "Confidential Marriage License", the
subsequent marriage ceremony must take place within the
county of license issuance. For the "public" to
obtain a copy of the couple's California Confidential Marriage
License, a court order must be sought. Only the couple whose
marriage license it is, are authorized request a copy of
the same.
This
license is usually preferred by eligible couples if in
occupations which protection of private information is
desired. For example, movie star, judge, attorney, tax
assessor or adjuster, sports star, police, Homeland Security,
medical doctor, or certain government officials, etc.
Or simply for the couple that prefers to keep personal
information, personal.
The County Clerk in the county of issuance or The Clergy
Network, if marrying in Orange County California, may
issue the California Confidential Marriage License. To
be eligible for this type of marriage license, the applicants
must be living together prior to the marriage license
application.
California
Residency Requirements For Marriage License Issuance |
There
is no residency requirement in order to marry within the State
of California. However, a California Marriage License must be
issued in order for the marriage to be official. |

Marriage
Ceremony |
Once,
a marriage license is issued in California state, the marriage
ceremony may be civil or religious in nature.
Practically speaking, when a marriage ceremony is not performed
at the California County Clerk's office, only Clergy or certain
Judges may officiate a wedding ceremony. There is no "Justice
of the Peace" system in California. In practice Non-Denominational
Clergy are the "Justices Of The Peace" in the State
of California. The Clergy Network is one of the few Non-Denominational
Clergy services in California - TCN offers a "civil",
"justice of the peace like" division and a Clergy
division for couple's the religious ceremony.

Return
of the Marriage License After The Wedding Ceremony |
If
not married at the County Clerk's office, the marriage license
must be returned to the County Recorders' office in the County
that issued the marriage license and by the person presiding
over the wedding ceremony.
"Certified
Copies" of the marriage license may be obtained from
the County Recorder's office, in the county that issued the
marriage license. The certified copy or copies may be picked
up in person, ordered on-line or through the mail. Acceptable
types of payment for certified copies may vary by county.

In
California, your wedding officiator may file your request for
certified copies at the same time that they return the marriage
license to the County Clerk Recorders' office. This is one of
the quickest ways to obtain certified copies of a marriage license
for name change notification purposes. This helpful time saving
practice is a standard part of Clergy Network services. Most
Southern California clergy or officiators or ministers do not
provide this as a part of their services. |

Fees |
Contact
the County Clerks office nearest you for specifics. In California,
each county determines their own marriage license fee scale
(with some counties charging $85.00 for a marriage license).
This does not include time and wages lost from work, gasoline,
public parking fees, etc. In some counties marriage license
application and issuance is a two day process, while in others
3-5 hours.

Applicants

In
addition to the identification and consent of one parent or
legal guardian, court permission is required.
Certain
counseling of minors may be required.
Consent
forms can be obtained from the County Clerk's office that
will be issuing the marriage license. The consent form must
be signed in the presence of a Deputy County Clerk or a Notary
Public by one parent or legal guardian. The person consenting
must present proof of identity. If the legal guardian is signing
the consent, bring the certified Letters of Guardianship.

you for specific details on where to apply for such an order.
